1. About these terms
These Terms of Service ("Terms") apply to the LiveHushh mobile apps, the website livehushh.com and related services (together, "LiveHushh"). LiveHushh lets diners discover restaurants, watch live streams, order food, book tables and join waitlists, and lets restaurants reach diners.
By creating an account or using LiveHushh you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use LiveHushh.
LiveHushh is a platform. The restaurant you order from or book with — not LiveHushh — prepares your food and provides the dining service.
2. Your account
- You must be at least 18 years old (or the age of majority where you live) to create an account.
- Give accurate information and keep it up to date. Keep your password private — you are responsible for activity on your account.
- Diner accounts are for personal use. Restaurant owner accounts must be created by the restaurant's owner or someone authorised to act for the restaurant.
- Tell us straight away at support@livehushh.com if you think someone else has used your account.
3. Ordering, booking & waitlists
- Orders. Menus, prices, taxes, delivery fees, availability and preparation times are set by each restaurant. An order is a request to the restaurant; the restaurant may accept, change or decline it.
- Live deals. Discounts shown during a live stream are offered by the restaurant and apply only while that stream is live and under the restaurant's conditions.
- Table bookings. A booking holds a table for the time shown. Please arrive on time and cancel in the app if your plans change. Restaurants may set their own late-arrival and no-show rules. A "requested" table is not confirmed until the restaurant confirms it.
- Waitlists. Wait times are estimates. Your place may change if you are not there when called.
- Allergies and dietary needs. Menu descriptions come from the restaurant. Always tell the restaurant directly about allergies — LiveHushh cannot guarantee ingredients or preparation.
4. Payments, cancellations & refunds
- Card payments are processed by our payment provider, Stripe. LiveHushh does not store your full card number.
- You can choose to pay in the app by card where offered, or pay the restaurant directly (at the restaurant, on pickup or on delivery).
- You can cancel an order in the app until the restaurant starts preparing it. After that, please contact the restaurant.
- If you paid in the app and your order was cancelled, not fulfilled, or charged in error, contact support@livehushh.com within 30 days. We will work with the restaurant and refund the amount to your original payment method where the order was not provided as described. Refunds usually appear within 5–10 business days depending on your bank.
- Complaints about food quality or service are handled by the restaurant in the first instance; we will help where we can.
5. Restaurant information
Some restaurant profiles are created by LiveHushh from information the restaurant publishes itself, such as the address, phone, menu and photos on its official website. These profiles are marked as a preview, show where the information came from, and do not take orders or bookings until the restaurant approves them.
Restaurant owners can claim their profile to correct or manage it, or ask us to remove it, by emailing support@livehushh.com. Information on preview profiles may be out of date — check with the restaurant before you visit.
6. Terms for restaurants
If you use LiveHushh as a restaurant owner or manager, you also agree that:
- You are authorised to act for the restaurant, and the information you publish (menu, prices, hours, photos, deals) is accurate and yours to use.
- You are responsible for the food you prepare, food safety and hygiene, allergen information, licences and permits, and all taxes on your sales.
- You will handle orders, bookings and waitlist guests you accept through LiveHushh in a timely and professional way, and honour live deals you publish.
- When you claim a profile with a claim code, you confirm you represent that restaurant. We may ask for proof and may suspend a claim we believe is not genuine.
- You will treat diners' personal information (names, phone numbers, emails) only to fulfil their orders, bookings and waitlist requests, and in line with applicable privacy law.
- How card payments for orders are settled with your restaurant is set out in your restaurant onboarding agreement with LiveHushh.
7. Restaurant plans & billing
- Restaurant plans (Starter, Pro and Enterprise) are monthly subscriptions at the price shown when you subscribe. New restaurants start with a 14-day free trial; no card is needed for the trial.
- When you subscribe, you authorise us (through Stripe) to charge your card for the first month and then automatically every month until you cancel.
- You can cancel auto-renew at any time in the app (Billing) or on the website. Your plan stays active until the end of the month you have paid for. We do not refund partial months, except where the law requires.
- If a payment fails or your plan ends, your restaurant is hidden from diners until you renew.
- We may change plan prices with at least 30 days' notice; the new price applies from your next renewal after the notice period.
8. Live streaming & cameras
- Restaurants choose when to stream and which cameras to use. The restaurant is responsible for complying with the laws that apply to recording and streaming in its location, including telling guests and staff that the space is streamed (for example with clear signage).
- Point cameras at the kitchen, the food and the room's atmosphere — not at individual guests. Do not stream audio of private conversations, restrooms or other private areas, children who are the focus of the shot, payment screens or personal documents.
- Face blurring is used where the camera setup supports it, but it may not catch every face; restaurants must frame cameras with that in mind.
- Streams are live. Diners may not record, download or re-broadcast them.
- We may stop or remove any stream that breaks these Terms or the law.
9. Content you share
You keep ownership of what you post — chat messages, ratings, photos, menus and videos. You give LiveHushh a worldwide, non-exclusive, royalty-free licence to host, display and share that content on LiveHushh and in promoting LiveHushh, for as long as it is on LiveHushh. You are responsible for having the rights to what you post.
10. Acceptable use
Please don't: break the law; harass, threaten or discriminate against anyone; post false, misleading, hateful or sexual content; place fake orders or bookings; misuse deals or promo codes; impersonate a person or restaurant; scrape, copy or resell LiveHushh data; try to break or overload our systems; or use LiveHushh to send spam. We may remove content and suspend accounts that do.
11. Our intellectual property
The LiveHushh name, logo, apps, website and software belong to LiveHushh and its licensors. You may use them only as LiveHushh allows. Restaurant names, logos, menus and photos belong to the restaurants.
12. Third-party services
LiveHushh uses services from other companies, such as Stripe (payments), Amazon Web Services (hosting, email and live video), Apple Maps and OpenStreetMap (maps), and Apple and Google (app stores and push notifications). Their own terms may also apply when you use those features.
13. Disclaimers
LiveHushh is provided "as is" and "as available". We work to keep it accurate and running, but we do not promise it will always be available, error-free, or that restaurant information, wait times, live streams or deals will be accurate or available. Nothing in these Terms limits rights you have under consumer protection laws that cannot be excluded.
14. Limitation of liability
To the extent the law allows, LiveHushh is not liable for indirect, incidental, special or consequential losses, or for the food, service or conduct of restaurants. Our total liability for any claim relating to LiveHushh is limited to the greater of (a) the amount you paid through LiveHushh in the 12 months before the claim, or (b) US$100. Restaurants agree to indemnify LiveHushh against claims arising from their food, service, streams or content.
15. Ending your account
You can stop using LiveHushh at any time and ask us to delete your account on our Account Deletion page. We may suspend or close accounts that break these Terms or put others at risk. Sections that by their nature should continue (for example payments owed, content licences, disclaimers and limitation of liability) survive.
16. Changes to these terms
We may update these Terms as LiveHushh changes. We will show the new date at the top and, for important changes, tell you in the app or by email before they apply. If you keep using LiveHushh after the changes apply, you accept the updated Terms.
17. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict-of-law rules, except where the consumer laws of the place you live give you rights that cannot be changed by agreement. Please contact us first — most concerns can be resolved quickly.
